SERVICE

The primary Service provided by SoftCopy is of document digitisation. Additionally, content hosting services are also made available on a secured server.

PAYMENT

You agree to pre-pay the subscription fees indicated for the services chosen, to the credit of SoftCopy in the account prescribed. If an incremental service is required by the subscriber, it will be payable separately. The fees will be levied from the date of commencement of provision of service for the subscription period and will be non-refundable.

 

SECURITY

It is the responsibility of the subscriber to ensure that their passwords are safe and secure. Utmost efforts are taken by SoftCopy to ensure security of the subscriber’s content, which is hosted using  secure third party server and software. Similarly, subscribers’ passwords are encrypted and stored on the server.

EXCLUSION OF LIABILITY

Access to digital material requires an internet connection. SoftCopy is not responsible for any deficiency in service arising due to connection related issues. The services offered by SoftCopy are not covered by warranty  or guarantees of any kind. The subscriber agrees to use these services “as is” at their own risk.

LIMITATION OF LIABILITY

SoftCopy assumes no responsibility with regards to the contents of the material hosted on behalf of its subscribers. SoftCopy claims no responsibility for the sharing of files with others.

FORCE MAJEURE

SoftCopy shall not be liable for delay in/failure to perform its obligations if the failure results from causes beyond its reasonable control, including but not limited to acts of nature, acts of Governments or other governing authorities, strikes, fire, explosion, accident, power failure, equipment failure, system failure.

TERMINATION OF SERVICE

The subscriber may choose to stop using the services of SoftCopy at any time by closing their account or ceasing to use the service. In such event, subscriber ill not be entitled to refund of subscription fees paid. SoftCopy reserves the right in its sole discretion, to suspend or cease providing all or any part of the service at any time, with or without cause, without any notice. 

 

GOVERNING LAW AND JURISDICTION

SoftCopy’s subscription services shall be governed by Indian law. Any disputes arising with regard to services of SoftCopy shall be referred to and finally settled by arbitration under the Arbitration Rules of India with the seat of arbitration and venue as Mumbai.
